Escrow Policy

1. Introduction

Paycul's Escrow Service is designed to create a safer marketplace for buyers and sellers by temporarily holding payments until the conditions of a transaction have been satisfied.

Instead of paying the Seller immediately, eligible payments are placed into a secure escrow account managed by Paycul. This allows Buyers to verify that they received the correct digital product while ensuring Sellers know that the Buyer has already committed payment.

This Escrow Policy explains how Paycul's escrow system operates, the responsibilities of Buyers and Sellers, and how funds are released, refunded, or resolved during disputes.

This policy forms part of Paycul's Terms of Service.

2. What is Escrow?

Escrow is a payment protection service. When a Buyer completes payment:

  1. Payment is successfully processed.
  2. Funds are placed into Paycul Escrow.
  3. The Seller is notified.
  4. The Seller delivers the purchased product.
  5. The Buyer reviews the delivery.
  6. Funds are released only after the transaction is completed according to this Policy.

Escrow protects both parties by reducing the risk of fraud.

3. Transactions Covered

Unless otherwise stated, Paycul Escrow applies to eligible marketplace transactions involving:

  • Digital products
  • Software licenses
  • Source code
  • Templates
  • Graphics
  • Courses and digital downloads
  • Premium memberships
  • Website assets
  • Social media assets (where permitted)
  • Other approved digital products

Paycul reserves the right to determine whether a particular transaction qualifies for escrow protection.

4. Funding Escrow

Once payment is confirmed:

  • The Buyer is charged.
  • The payment is securely held by Paycul.
  • The Seller receives notification of the order.
  • Delivery may begin.

Holding funds in escrow does not mean the Seller has been paid. Funds remain unavailable until they are released under this Policy.

5. Seller Responsibilities

Sellers must:

  • Deliver exactly what was advertised.
  • Deliver within the stated timeframe.
  • Ensure download links work and login credentials are valid.
  • Deliver complete files.
  • Respond promptly to Buyer questions.
  • Cooperate during return requests and disputes.

Failure to meet these obligations may result in refunds, account penalties, or suspension.

6. Buyer Responsibilities

Buyers are expected to:

  • Read product descriptions before purchasing.
  • Carefully inspect the delivered product.
  • Verify download links, files, and login credentials where applicable.
  • Report problems promptly through Paycul.
  • Avoid releasing escrow funds until satisfied.

Buyers should not delay reviews unnecessarily after receiving a valid delivery.

7. Delivery Confirmation

A product is considered delivered when the Seller has supplied the digital asset, download link, access credentials, license key, or other agreed method of delivery described in the listing.

Delivery alone does not automatically release escrow funds. The Buyer must still be given an opportunity to inspect the product.

8. Buyer Review Period

After delivery, Buyers are provided with a review period to download the product, verify functionality, confirm the files are complete, and check that the product substantially matches the listing.

The applicable review period may vary depending on the transaction type and will be displayed during checkout or within the order details.

If no action is taken before the review period expires and no return request or dispute has been initiated, Paycul may automatically release the escrow funds to the Seller.

9. Releasing Escrow Funds

Buyers should release funds only after they have confirmed that:

  • The correct product was delivered.
  • Required files have been received.
  • Access credentials work.
  • The product substantially matches the listing.
  • No unresolved issues remain.

Once a Buyer voluntarily releases escrow funds, that action is generally final and irreversible. Buyers should never release funds based solely on promises of future corrections or updates.

10. Automatic Release

To ensure transactions are completed in a reasonable timeframe, Paycul may automatically release escrow funds when:

  • The Buyer has received delivery.
  • The review period expires.
  • No return request has been filed.
  • No dispute has been opened.

Automatic release helps prevent unnecessary delays for Sellers who have fulfilled their obligations. Buyers are responsible for reviewing their purchases before the review period expires.

11. Return Requests

If a Buyer believes the delivered product does not substantially conform to the listing, the Buyer may submit a Return Request before escrow funds are released. Return Requests encourage Buyers and Sellers to resolve issues directly without requiring a formal dispute.

Examples include:

  • Broken download links.
  • Missing files.
  • Invalid login credentials.
  • Wrong product delivered.
  • Product materially different from its description.

Submitting a Return Request does not automatically entitle the Buyer to a refund. The Seller will have an opportunity to respond.

12. Seller Response to Return Requests

After receiving a Return Request, the Seller may:

  • Accept or reject the request.
  • Upload corrected files or replace invalid credentials.
  • Provide missing components.
  • Clarify misunderstandings or resolve the issue through communication.

Paycul encourages both parties to cooperate in good faith to reach an amicable resolution.

13. Escalating to a Dispute

If the Buyer and Seller cannot resolve a Return Request, either party may escalate the matter by opening a formal dispute. Once a dispute has been opened:

  • Escrow funds remain frozen.
  • Neither party may withdraw the funds.
  • Paycul will review available evidence before making a decision.

Both parties are expected to cooperate fully during the investigation.

14. Dispute Investigation

When a dispute is escalated, Paycul conducts a fair and impartial review based on the information available at the time of the investigation. Our goal is to determine whether the Buyer or Seller has fulfilled their obligations under the Terms of Service, this Escrow Policy, and the applicable product listing.

During an investigation, escrow funds remain securely held until a final decision is made.

15. Evidence Requirements

To assist in resolving disputes, Paycul may request evidence from either or both parties. Examples include:

  • Screenshots and screen recordings.
  • Download logs and chat messages.
  • Product descriptions and listing history.
  • Delivery confirmations and login attempts.
  • Technical error messages, file metadata, and transaction records.

Failure to provide requested evidence within a reasonable period may affect the outcome of the dispute. Paycul may also rely on internal records, security logs, and transaction history when evaluating a case.

16. Decision Criteria

Each dispute is reviewed individually. Factors that may be considered include:

  • Whether the product matches the listing.
  • Whether delivery occurred within the agreed timeframe.
  • Whether required files or credentials were provided.
  • Whether the Buyer attempted to resolve the issue before escalating.
  • Whether either party violated Paycul's policies.
  • Previous account history where relevant.
  • Evidence of fraud or abuse.
  • Technical information available to Paycul.

No single factor automatically determines the outcome of a dispute.

17. Dispute Outcomes

Following review, Paycul may:

  • Release all escrow funds to the Seller.
  • Refund the Buyer in full.
  • Issue a partial refund where appropriate.
  • Require additional information before making a decision.
  • Remove the product listing.
  • Suspend or restrict an account.
  • Apply administrative penalties where policy violations are identified.

Paycul's decision is based on the evidence available and is final unless otherwise required by applicable law.

18. Refunds Through Escrow

Where a refund is approved, Paycul will return eligible funds to the Buyer using an appropriate payment method. Depending on the original payment method, refunds may be issued to:

  • The Buyer's Paycul Wallet.
  • The original payment method where technically possible.
  • Another approved refund destination determined by Paycul.

Refund processing times may vary depending on payment providers and financial institutions.

19. Partial Refunds

In some circumstances, a full refund may not be the most appropriate outcome. Examples include situations where:

  • Only part of a digital product is defective.
  • Certain promised features were delivered while others were not.
  • Both parties contributed to the issue.
  • A negotiated settlement has been reached.

Where appropriate, Paycul may authorize a partial refund that reflects the circumstances of the transaction.

20. Fraud and Abuse

Paycul has zero tolerance for fraud. Examples of prohibited conduct include:

  • Submitting false evidence or altering screenshots or recordings.
  • Knowingly making false claims.
  • Attempting to obtain products without payment.
  • Delivering unauthorized or stolen digital products.
  • Circumventing the escrow system.
  • Creating fake accounts to manipulate transactions.
  • Coordinating fraudulent disputes.

Users found engaging in fraudulent conduct may face:

  • Account suspension or permanent termination.
  • Forfeiture of escrowed funds where permitted by law.
  • Administrative penalties and loss of referral rewards or promotional benefits.
  • Referral to relevant authorities where required by applicable law.

21. Administrative Penalties

Where Paycul determines that a Buyer or Seller has intentionally acted fraudulently or abused the escrow process, we may apply administrative penalties in addition to other enforcement actions. Such penalties may include:

  • Monetary fines where permitted by law.
  • Temporary feature restrictions or permanent marketplace bans.
  • Removal of listings and loss of seller privileges.
  • Withholding of promotional rewards.

The purpose of these penalties is to protect honest users and maintain the integrity of the Platform.

22. Seller Payouts

Once escrow funds have been released, the Seller's proceeds will be credited to their Paycul Wallet, less any applicable marketplace fees. Sellers may request withdrawal of available balances in accordance with Paycul's Withdrawal Policy and any applicable verification requirements.

Paycul may delay payouts where reasonably necessary to investigate fraud, comply with legal obligations, resolve technical issues, or correct payment processing errors.

23. Escrow Fees

Paycul charges fees for providing escrow services. Applicable fees are disclosed before a transaction is completed and may vary depending on transaction type, marketplace promotions, premium memberships, country-specific requirements, or other factors determined by Paycul.

Escrow fees are generally non-refundable once the escrow service has been provided, except where required by law or expressly stated otherwise.

24. Force Majeure

Paycul shall not be liable for delays or interruptions in escrow services caused by events beyond our reasonable control, including but not limited to natural disasters, power failures, internet outages, cybersecurity incidents, government actions, financial network disruptions, war, civil unrest, or similar events.

Where such events occur, Paycul will make reasonable efforts to restore services as quickly as practicable.

25. Changes to this Escrow Policy

Paycul may update this Escrow Policy from time to time to reflect changes in applicable laws, improvements to the Platform, operational changes, security enhancements, or new escrow features.

Material changes will be communicated through appropriate channels, including the Platform or email where required. The "Last Updated" date at the beginning of this Policy reflects the most recent revision.
